New Public Procurement Act of 29th January 2004 Art. 26 section 4 Journal of Laws - Dz. U. No.19. and the Ordinance of the Minister Council of 7th April 2004 Journal of Laws - Dz. U. No. 71 item 675/2004 paragraph 1 section 2, subsection 7 says that the Ordering Party has the right to require in public tenders „… a certificate of the entity entitled to quality control stating that the Contractor fulfils quality obligations in the scope of services which are the subject of the Order; or any other equivalent document confirming the quality of services provided if the Contractor cannot obtain the required certificate”. It means that each organisation which plans its participation in public procurements will have to, starting from 2007 (as the Schengen Agreement starts to be valid), have the Quality Management System certificate according to ISO 9001, including the declared sub-suppliers of the Main Contractor.
